【中国观察2020年12月11日讯】德州以选举过程违宪为由,要求美国最高法院否决4个摇摆州的投票结果,美国总统川普和全国18州随即群起响应,支持德州诉讼案。截至11号为止,有106位众议员支持德州对4个摇摆州涉嫌选举违宪的指控。
根据这106位共和党众议员支持德州案的陈述书,“本摘要引起我们作为国会议员的关注,成千上万的选民对此表示赞同,认为2020年总统大选涉及违宪违规行为,因而对大选结果产生怀疑。”
德州的联邦众议员兰斯·古登(Lance Gooden)在推特发文表示:“每个人都对选举舞弊有自己的看法。我对人们的看法不感兴趣,我想要的是事实。”
与此同时,民主党22州的总检察长也向美国最高法院致函,要求拒绝受理德州的诉讼。
旅美时事评论员唐靖远:“共和党这边的州,他们支持德州是有实质性的意义的。我们看到至少已经已经六个州,它不仅是表态来支持,它是已经实质性的提出申请要加入到诉讼当中去。也就是说,他们都希望自己会成为原告的一部分。但是我们看到了被告的这一方,就是说虽然也有二十个州表态支持这个被告,但是实际上他们并没有实质性的意义,他们更多的只能是一种舆论上面的意义。”
旅美时事评论员蓝述认为,按照美国建国先父所撰写的原意去诠释宪法,毫无疑问德州的诉讼会胜利。现在跳出来支持被告的这些人,试图用他们的政治影响力来影响美国司法系统的独立性。
旅美时事评论员蓝述:“现在这些蓝州,他们代表的是蓝州的那一些政治团体,但是他们本人并不是受害人,而真正受害的是所有的生活在美国的尊重美国宪法的美国人。所以说这些蓝州的这些人,他实际上就是想把他们的政治利益凌驾于司法程序之上,希望影响最高法院,让最高法院按照他们的意志去审理这个德州的诉讼,而不是按照宪法的原意去审理德州的诉讼。”
德州1836年宣布从墨西哥独立,1845年加入美国联邦,成为美国第28个州,也是全美国唯一以独立国家身份加入美国联邦的州。 德州众议员比德曼(Kyle Biedermann)在脸书贴文,《德州宪法》在第1条第2款中指出:所有政治权力是人民固有的,所有自由政府都为他们的利益而建立……德州人在任何时候都拥有以他们认为的方式改变、改革或废除政府的不可剥夺的权利。
唐靖远:“很多的州它之所以能够留在这个联邦之内,它其实靠的就是这个美国宪法。如果说,出现最高法院这一次的这个判决,如果它不能够公平的维护宪法的尊严和地位,那么以后任何一个州都可以像这一次民主党的这几个州,就是它随便找一个借口就可以去破坏宪法,就可以去修改宪法,甚至是无视宪法的这个规定和权威,那么整个美国很有可能都会解体。”
旅美时事评论员唐靖远认为,过去德州民众因为认为墨西哥政府违宪,所以起来革命从墨西哥独立,如果最高法院判德州诉讼失败,就等于宣布美国宪法已经失效,作为全美最大的第二经济体的德州,难保不会再次宣布独立。
唐靖远:“现在表面上体现出来是共和党和民主党之间的一个对立,我觉得这个是表面现象。其实这一场诉讼它的实质上的本质,是针对美国宪法的护宪之战。这个也就是我们看到为什么川普总统他说,如果说这一次的舞弊不能够被根除的话,那么美国就不会再有国家了。”
就在德州向最高法控诉4州违宪选举时,美国联邦调查局FBI宣布,侦破拜登的50万张假选票案。
美国白宫贸易顾问纳瓦罗(Peter Navarro)表示,他将很快发布报告、揭示美国大选四个摇摆州的异常表现。

Meanwhile, the Democratic Party's 22 state attorneys general have sent a letter to the U.S. Supreme Court asking that the Texas lawsuit be denied.
