Presidential electors voted in every state in the U.S. on Monday (Dec. 14), but at least seven states had "double voting" at the same time. Stephen Miller, a senior White House adviser, said the "alternative" electoral rolls open the door to a legal challenge by President Trump.
Miller noted that the "alternative" electoral votes sent to Congress show that even after the Electoral College confirms Biden as the winner, Trump could continue his efforts to overturn the election results.
On Monday's Fox News, Miller also dismissed the idea that the Electoral College vote marked the end of the electoral process.
"The only date in the Constitution is Jan. 20, so we have plenty of time to correct this fraudulent election result and prove that Trump is the winner of the election." Miller said on "Fox & Friends.
"As we speak, today, contested states will be voted on by alternative electors, and we will send those results to Congress." Miller continued, "This will ensure that all of our legal remedies remain unfolded. It means that if we win these cases in court, we can simply ask for certification of the alternative electoral votes."
Miller also floated the idea of a state legislature stepping in to overturn the election results or Congress intervening.
Rudy Giuliani, a lawyer for the Trump campaign, and Jenna Ellis, senior counsel, have made similar requests. Ellis said President Trump's legal battle remains very much alive.
"President Trump has every right, and indeed every American voter has an obligation, to continue to work to preserve the integrity of the election to ensure that truth and the constitutional process, not corruption, prevails." Ellis said state legislatures have more than enough time from Tuesday through early January to retrieve electoral votes and restore electoral integrity.
Trump told Fox News in a Sunday interview that he plans to move forward with a number of other election challenges and that "this is not over" and "we're going to keep moving forward, we're going to keep moving forward."
Trump continues to file new lawsuits, the most recent of which was filed Monday against the state of New Mexico. Trump alleges that the state's election officials directly violated the Constitution by flouting state law regarding vote by mail, citing the Communist Party's viral pandemic.
The next stop in the election process, as mandated by the U.S. Constitution, is a joint session of Congress, to be held at 1 p.m. Jan. 6, where members of Congress will tabulate, inspect and certify the electoral votes.
