【中国观察2020年12月26日讯】据威斯康星州公共广播电台(Wisconsin Public Radio, WPR)报导,近日该州两位共和党州议员杰夫•穆尔绍(Jeff Mursau)和大卫•塞特芬(David Seteffen),已经签署了最新的联邦诉讼案,要求推翻民主党总统候选人乔•拜登(Joe Biden)在威斯康星州、宾夕法尼亚州、密歇根州、乔治亚州和亚利桑那州赢得选举的认证结果。

共和党州议员黛比•雅克(Debbie Jacques)也是原告之一。他们于本周二(12月22日)加入了“威斯康星州选民联盟”(Wisconsin Voters Alliance)在美国哥伦比亚地区法院提起的诉讼,要求这5大摇摆州的州议会在(国会)计票前,对总统选举人团进行认证。这一诉求是前所未见的。

该诉讼的被告包括副总统迈克•彭斯(Mike Pence)、美国国会、威斯康星州民主党籍州长托尼•埃弗斯(Tony Evers)、州议会共和党籍议长罗宾•沃斯(Robin Vos)等。

托马斯•莫尔协会(Thomas More Society)下属的阿米斯塔德项目(Amistad Project)律师埃里克•卡达尔(Erick Kaardal)在一份法律简报中指出,在没有州立法机构支持的情况下,让州长认证选举人团违反了美国宪法。

塞特芬议员在一份电子邮件声明中表示,这项诉讼的前提是关于州立法者的宪法角色和责任,立法者不应放弃他们对选举人团的决定权。

“无论是州宪法还是美国宪法中分配给立法者的权力,如投票、选区地图设计或确定选举人团的权力,都不能转让给一个官僚机构、组织或其他第三方。”塞特芬写道。

威斯康星州拥有10张选举人票,该州政府目前认证了拜登的选举人团。

穆尔绍议员在谈到相关争议问题时,对在线杂志“威斯政治”(WisPolitics)说:“我所有的选民都在大声呼吁需要有人站出来做点什么。”

Several members of the Wisconsin General Assembly recently signed a federal lawsuit to overturn the fraudulent certification of election results in five swing states. The lawsuit defendants include Vice President Pence, Congress, and various Wisconsin executive and legislative officials.

[China Watch, Dec. 26, 2020] Wisconsin Public Radio (WPR) reports that two of the state's Republican state legislators, Jeff Mursau and David Seteffen, have recently signed on to the latest federal lawsuit seeking to overturn the certification of election results won by Democratic presidential candidate Joe Biden in Wisconsin, Pennsylvania, Michigan, Georgia and Arizona.
Republican state Rep. Debbie Jacques (D) is also one of the plaintiffs. They joined a lawsuit filed by the Wisconsin Voters Alliance in the U.S. District Court for the District of Columbia on Tuesday (Dec. 22), asking the state legislatures of the five swing states to certify the presidential electoral college before the votes are counted (in Congress). This claim is unprecedented.

Defendants in the lawsuit include Vice President Mike Pence, the U.S. Congress, Wisconsin's Democratic Governor Tony Evers, and Robin Vos, the Republican Speaker of the State Assembly.

In a legal brief, Erick Kaardal, an attorney with the Amistad Project, an affiliate of the Thomas More Society, argued that having the governor certify the Electoral College without the support of the state legislature violates the U.S. Constitution.

In an emailed statement, Rep. Sutphin said the premise of the lawsuit is about the constitutional role and responsibility of state lawmakers, who should not abdicate their right to decide on the Electoral College.

"Neither the powers assigned to legislators in the state constitution nor the U.S. Constitution, such as the power to vote, design district maps or determine the Electoral College, can be transferred to a bureaucracy, organization or other third party." Setter Finn wrote.

Wisconsin has 10 electoral votes, and the state government currently certifies Biden's Electoral College.

Speaking to the online magazine WisPolitics about the controversy, Rep. Murthaud said, "All of my constituents are crying out for someone to step up and do something."
